Terms of Use

These Terms of Use ("Terms") govern your access to and use of My Santa Teresa Home (the "Platform", "we", "us", or "our"), operated from Santa Teresa, Puntarenas, Costa Rica. By creating an account, listing a property, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy and Cookie Policy.

1. About the Platform

My Santa Teresa Home is a gated rental marketplace focused on monthly and seasonal stays in Santa Teresa and the Nicoya Peninsula of Costa Rica. We connect property owners ("Owners") with prospective renters ("Renters"). We are a neutral venue: we do not own, manage, control, or inspect any listed property, and we are not a party to any rental agreement, booking, or payment between Owners and Renters.

2. Eligibility & accounts

You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3. Renters

Browsing the marketplace is free. Renters create a profile (which may include name, photo, stay dates, and preferences), may submit contact requests to Owners, and receive Owner contact details only after a request is accepted. You agree to use contact information solely to arrange a legitimate rental and not for marketing, spam, or any unlawful purpose.

4. Owners & listings

Owners are responsible for the accuracy, legality, and completeness of their listings, including prices, availability, amenities, and photos. By publishing a listing you represent that you have the legal right to rent the property and to upload its content. A listing fee of US$45 per year per property applies as described at sign-up. Listings must comply with applicable local laws, including any registration, tax, and short-term-rental requirements.

5. User content & media license

You retain ownership of the content you submit (text, photos, and other materials). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content for the purpose of operating, securing, and promoting the Platform and your listing.

Photography & social media. Where you give consent (for example, the photo & social-media consent presented when you create or edit a listing, or when you create an account), you authorize us and our service providers to photograph the relevant property and to use those photos and related listing content in marketing and promotional materials, including on social media channels. You may withdraw this consent at any time for future use by contacting us or submitting a privacy request; withdrawal does not affect materials already published or distributed.

6. Acceptable use

You agree not to: post false, misleading, infringing, or unlawful content; impersonate others; harvest data or contact details; circumvent the gated access or fees; upload malware; or interfere with the Platform's operation or security. We may remove content and suspend or terminate accounts that violate these Terms.

7. Fees & payments

The Platform does not process rental bookings or payments. Once a contact request is accepted, Owners and Renters arrange bookings and payments directly between themselves and bear all associated risk. Listing fees, where applicable, are described at the point of purchase and are non-refundable except where required by law.

8. Third-party dealings & links

Any dealings between Owners and Renters, and any reliance on third-party links or services, are solely between you and the other party. We are not responsible for the conduct, listings, properties, or content of any user or third party.

9. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that listings, Owners, Renters, or properties are accurate, safe, legal, or suitable, and we do not guarantee uninterrupted or error-free service.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a rental arrangement, an interaction between users, or your use of the Platform. Our aggregate liability for any claim relating to the Platform will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of your content, your use of the Platform, your rental arrangements, or your violation of these Terms or any law or third-party right.

12. Suspension & termination

You may stop using the Platform at any time and may request deletion of your account via a privacy request. We may suspend or terminate access if you violate these Terms or to protect the Platform or its users.

13. Governing law & disputes

These Terms are governed by the laws of the Republic of Costa Rica, without regard to conflict-of-law rules. The competent courts of Costa Rica will have jurisdiction, except where mandatory consumer-protection law grants you rights in your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. The version number and effective date shown on this page indicate the current version. Material changes take effect when posted; your continued use after the effective date constitutes acceptance. We record the version you accepted when you create your account.
